General terms & conditions Chiccham
CHICCHAM SA – General Terms and Conditions (hereinafter “General T&C”)
The present General T&C shall apply to all orders submitted via the website http://www.chiccham.com (hereinafter “the Site”). Any provision that deviates from these terms and conditions and agreements made verbally or by telephone shall only be valid if expressly approved in writing.
A. General conditions of sale
Representation on the Site
Chiccham SA shall display on the Site products for sale along with information that allows the potential buyer to identify, prior to placing an order, the main features of the products. Any corresponding representation of goods and colours featured on the Site, however, shall be given as a guide only. Such information shall have no contract value and shall not in any way invoke the liability of Chiccham SA.
Orders
An offer to purchase shall be formed when the buyer submits an order, which we accept by sending a confirmation e-mail. Chiccham SA reserves the right to refuse any offer to purchase made by the Buyer at our exclusive and full discretion, particularly in the event that stocks of the goods ordered have been exhausted.
Price
The prices stated are expressed in Swiss francs. These prices include VAT but exclude shipping and any other taxes to be paid by the Buyer.
Chiccham S.A. reserves the right to amend these prices at any time.
Shipping and handling costs
Chiccham SA shall charge a share of the shipping and handling costs on all orders:
9 CHF (nine Swiss francs) up to 2kg
11 CHF (eleven Swiss francs) up to 5kg
12 CHF (twelve Swiss francs) up to 10kg
VINTAGE FURNITURE:
Delivery not included. The items can be taken in our warehouse according to the standard opening hours from Monday to Thursday or by appointment. Items must be picked up no later than 2 weeks after purchase or paid storage possible on request.

Delivery
Delivery shall be made directly to the postal address indicated by the Buyer at the time of placing the order. Delivery lead times shall be given as a guide only. These shall have no contract value and shall not in any way invoke the liability of Chiccham SA.
Payment
Payments can be made by credit card (VISA, MASTERCARD) or by debit card POSTCARD as well as PAYPAL.
Payment must be made in full at the time of placing the order, however the value of the order shall only be debited if the order is accepted by Chiccham SA.
Our site uses e-Commerce d’Ogone to process payments. This has been developed so that your payments can be processed securely and in confidence. All confidential information collected by Ogone e-Commerce via the Internet shall be encrypted in accordance with SSL standards.
Reservation of title
The goods shall remain the property of Chiccham SA until full payment has been received.
Right to return
If you are not completely satisfied with the goods you have ordered, you can return them to us as new and unused in their original packaging within 7 (seven) days of receipt of the goods. All returns must be labelled using the pre-printed address label available from the Chiccham SA Site. We shall accept no liability for the goods that are returned. You shall be liable for payment of the return shipping costs.
In the event that you wish to return goods, you may either:
- exchange the goods;
- obtain a refund of the amount of the goods, if already paid, to an account the details of which must be provided by you;
- obtain a credit note from Chiccham SA equal in amount to the price of the goods returned.
Custom-made goods that have been manufactured at the request of the Buyer cannot be exchanged or returned. This provision shall be subject to the rights resulting from faults and defects as defined below.
Promotions or sales can't be returned ou refunded.
VINTAGE FURNITURE:
As the furniture is vintage, traces of use are naturally present. All other marks exceeding normal will be reported. The furniture is sold as it stands, and cannot be returned or exchanged.
Faults and defects
Visible faults and defects, including delivery errors, must be reported immediately and no later than 5 (five) working days from receipt of the delivery.
Hidden faults and defects and faults and defects that subsequently appear must be reported immediately and no later than 5 (five) working days from the date of their discovery.
All complaints should be sent by e-mail to the following address: info@chiccham.com.
Chiccham SA shall then decide whether to remedy the faults and defects free of charge or to send a replacement product of the same value, if the fault is proven and reduces the value of the goods. If we are unable to remedy the faults and defects or to supply a replacement product within a reasonable period, we shall be entitled to cancel your purchase and reimburse the price paid, or to reduce the price as a result (reduction). The goods remain our property.
This clause shall not cover damage caused by improper maintenance, a failure to follow the operating instructions or any other improper action taken by the Buyer.
B. General conditions of use for the Site
Registration
By registering on the Site, you agree to abide by the General T&C and guarantee Chiccham SA that: (1) you are an adult in your country of residence or have the authority necessary to bind the company that you represent to the transactions processed on the Site; (2) the information sent during the registration process are correct; (3) the information sent shall be kept up-to-date by you at all times.
You are exclusively responsible for access and for use of the access data (username, password) sent to you by Chiccham SA at the end of the registration process, over which Chiccham SA shall have no control, and you are exclusively liable for the consequences that may result from this. You undertake to immediately notify Chiccham SA of any fraudulent use that may be made of this access data.
Intellectual property
The content of the Site, including texts, graphics, photos and other illustrations of any kind, is protected by copyright and shall remain the sole and exclusive property of Chiccham SA. This content may not be used for any purpose other than the consultation of the Site without the prior written agreement of Chiccham.
The Chiccham logo and our slogan “Educate your sofa” may not be used in any form and for any purpose without the prior written agreement of Chiccham SA.
Waiver of liability for links
The Site includes a certain number of links that refer to other websites. Chiccham SA hereby expressly confirms that we have no influence whatsoever on the make-up and content of the pages referred to in the links. Furthermore, we hereby distance ourselves explicitly from the content of all third-party sites linked from our website and emphasise that this content is not our own. This declaration shall apply to all of the links displayed and all of the content of the sites to which these links refer.
C. Standard clauses
Liability
Except in the case of gross negligence or wilful intent on the part of Chiccham SA, all liability other than those forms resulting from faults and defects on goods as defined above in part A shall be excluded, whether in relation to the conclusion and performance of the contract or in relation to the Content of the Site.
Applicable law
All contracts concluded with Chiccham SA shall be governed by Swiss Law with the exclusion of the provisions arising from the Federal Law on Private International Law.
Any disputes arising directly or indirectly from the conclusion, interpretation or performance of a contract concluded with Chiccham SA in accordance with the General T&C shall fall under the exclusive jurisdiction of the District Court of Lausanne.
